Swarmd Terms of use

Brevz SAS is a company registered at 4 Rue Voltaire, 44000 Nantes, France (registration number: 898446141). Our technical infrastructure is provided by OVH and some of our databases are provided by Scaleway.

Our Data Processing Agreement (DPA) under the European General Data Protection Reguslation (GDPR) forms part of these Terms of Service.

Brevz SAS may revise the Terms of Service at any time without notice. By using the Service, you agree to be bound by the then current version of these Terms of Use.

1. Account

When you create an account on Swarmd, you are responsible for maintaining your account’s security, and you are fully responsible for all activities that occur under the account.

If an unauthorized uses of your account should happen, or any other breaches of security, you must immediately notify Swarmd’ support at support@brevz.io.

Brevz SAS will not be liable for any acts of ommissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Swarmd customers themselves also have customers, so we refer to our customers as “users”. We refer to the customers of those customers “visitors”.

2. Content

Brevz SAS does not review contents that are published throught Swarmd application. The content’s creator is the sole responsible of it’s content, and any harm resulting from that content. That is the case regardless of the content’s form, which includes, text, video, audio, photo, code. When submitting content to Swarmd, you allow Brevz SAS a world-wide, royalty-free and non-exclusive license to host, adapt, and publish the content provieded under your supervision. When you ask for a removal of a content, Brevz SAS will remove it but due to caching or technical complexity, you acknowledge it may not be immediatly deleted.

Brevz SAS has the right to:

• Remove any content that, in Brevz SAS’s opinion, violates any Brevz SAS’s policy, or is in any way harmful or objectionable.
• Terminate, deny access or limiting access to and use of Swarmd to any entity or individual for any reason.

3. Visitors

Brevz SAS disclaims any responsibility for any harm resulting from the use of Brevz SAS by visitors, or from any users’ content executed as Brevz SAS is only a Hosting Provider for the User code.

4. Disclaimer

The materials on Brevz SAS’s service are provided “as is”. Brevz SAS makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Brevz SAS does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet service or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall Brevz SAS or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Brevz SAS’ service, even if Brevz SAS or a Brevz SAS authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

6. Revisions

The materials appearing on Brevz SAS’s service could include technical or contents errors. Brevz SAS does not warrant that any of the materials on its service are accurate, complete, or current. Brevz SAS may make changes to the materials contained on its service at any time without notice. Brevz SAS does not, however, make any commitment to update the materials.

7. Links

Brevz SAS has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Brevz SAS of the site. Use of any such linked web site is at the user’s own risk.

8. Payment and Billing

All Brevz SAS’s subscriptions are handled by Stripe Checkout. (to ensure)

Unless you modify your Brevz SAS’s subscription before the end of the applicable subscription period that you want to cancel a subscription, the subscription will automatically renew.

If fee are not paid in the following 14 days after the due date, Brevz SAS’s has the right to permanently delete the Account including all client data.

Brevz SAS paid service shall be used by legal entities only (businesses and non-profits). It should not be purchased by individuals, individuals can use the free version.

9. Cancelation

Users can cancel their subscription at https://swarmd.io/app/billing.

In case of a Brevz SAS’s cancelation, Brevz will have no obligation to provide a refund of any amounts previously paid.

Users can delete their account by mailing us to mailto

@swarmd.io with their account’s mail address.

10. Update

Brevz SAS may revise these terms of use for its service at any time without notice. By using this service you are agreeing to be bound by the then currentversion of these Terms and Conditions of Use.

11. Governing Law

Any claim relating to Brevz SAS’ service shall be governed by the laws of France without regard to its conflict of law provisions.
